The Sheriff's Civil Division is required by law to charge fees for most services.  All fees will be paid prior to performing any service (Govt. Code 6103.2).  For your convenience, some of the more common fees are listed below.  For some levies, a deposit for other costs may need to be prepaid, including costs for moving, storage, towing, recording, publishing, keeper fees, etc.  For money judgment levies, the amount of fees paid are added to the amount the debtor must pay to fully satisfy the judgment.  The Sheriff is entitled to fees whether or not the service is completed, and successful service cannot be guaranteed.

General process - $50 per person served

Earnings Withholding Order - $45

Bench Warrant (Civil) - $175

Writ of Possession (Eviction) - $180

Bank Levy - $50 per bank

Vehicle Levy (Transfer Possession) - $2,000 ($125 fee + $1875 deposit)

Vehicle Levy (Auction to Pay Judgement) - $3,000 (various fees + deposit) 

Real Property Levy - $3,000 (various fees + deposit)

Notary - $15

Keeper (8 Hours) - $300

Till Tap - $125

 

Contact the Civil Division for other levies that require moving, storing, or auctioning property.  The upfront deposit will be determined based upon the size and complexity of the levy.

 

For seizure and sale of business inventory, a minimum of $1,500 fee deposit is required to conduct an inventory of the business and maintain keeper custody until the inventory can be removed from the premises. More may be required depending on the size and complexity of the levy.

Restraining Order Fee Exceptions – The Sheriff does not charge a fee to serve domestic violence or elder abuse restraining orders.  Civil harassment restraining orders may not require a service fee if it is ordered by the court to be waived.

Court-Ordered Fee Waiver Exceptions - The Civil Division will accept a court-ordered fee waiver in lieu of charging a fee.  The court case number on the fee waiver must match the court case number on the documents to serve.  The person to whom the fee waiver was issued must also be the person requesting the service.

Payments are accepted by cash, check, or money order.  Checks and money orders must be made out to Kings County Sheriff’s Office.
